Current situation

Cross-border commuters residing in Austria and working in Switzerland or Liechtenstein are usually subject to foreign health insurance legislation.

In concrete terms, this means that the country of employment in this case, Switzerland/Liechtenstein, is responsible under social security law, regardless of which form of health insurance a cross-border commuter chooses. The country of employment therefore remains responsible even if you have opted for private or statutory health insurance in Austria.

It was agreed that in the event of long-term care, the state responsible for long-term care benefits is the same state that is responsible for health insurance. For cross-border commuters from Austria, Switzerland or Liechtenstein is therefore responsible.

What care benefits can I expect as a cross-border commuter?

In Switzerland or Liechtenstein, you are only entitled to care allowance if you also live in this country. Cross-border commuters who live in Austria and only work in Switzerland or Liechtenstein are therefore not entitled to care allowance. Cross-border commuters can only expect benefits in kind from the country of employment.

When is Austria responsible or responsible again?

Giving up work as a cross-border commuter

After giving up work abroad, Austria is only responsible for care benefits (care allowance) from the point at which the Austrian health insurance is responsible.

Example: A cross-border commuter residing in Vorarlberg terminates his employment in Switzerland and then begins employment in Vorarlberg. From the start of the new employment relationship in Vorarlberg, the responsibility for health insurance and therefore also for care benefits (care allowance) lies with Austria.

 

Receipt of an Austrian basic benefit

Persons in need of care who reside in Austria and receive an Austrian basic benefit (e.g. pension, retirement pension, annuity, rehabilitation allowance) are entitled to Austrian care allowance.

Persons who have already paid into the Austrian system before starting work as a cross-border commuter are entitled to an Austrian basic benefit, e.g. all persons who have already worked in Austria. However, it is also important to know that it usually takes a long time (approx. 2 years) for such an Austrian basic benefit to be recognized.

What about people who have never paid into the Austrian system?

Cross-border commuters living in Austria who have never paid into the Austrian system, for example because they come from Germany and became cross-border commuters when they moved to Austria, are definitely not entitled to Austrian care allowance.

Care: The underestimated risk of needing care

No other risk is underestimated or suppressed as much as the risk of needing long-term care. It is already estimated that over 50 percent of people will need long-term care at some point in their lives. Looking at demographic trends, these figures are probably still very optimistic.

In 2015, over 5 percent of the Austrian population were in need of care. This proportion means that every 4th family has to care for someone in their immediate vicinity.
